ThinkFlow Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ThinkFlow application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and AppForges. If you do not agree to these Terms, please do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after such changes constitutes acceptance of the modified Terms.

2. Service Description

ThinkFlow is a desktop learning assistant application that provides: - Local video import and playback (MP4, MKV, AVI, MOV, WebM) - On-device speech recognition using Whisper (completely offline) - AI-powered mind map generation synchronized with video playback - Export capabilities (Markdown, and future PDF/image formats)

We strive to provide reliable and high-quality services but do not guarantee uninterrupted, error-free, or secure service at all times.

3. Account Registration

To use ThinkFlow's full features, you must create an account through AppForges OAuth. You agree to: - Provide accurate and complete registration information - Maintain the security of your account credentials - Notify us immediately of any unauthorized use of your account - Be responsible for all activities conducted through your account

You must be at least 13 years of age to create an account and use ThinkFlow.

4. User Content and Local Data

You retain full ownership of all content processed through ThinkFlow, including your videos, transcriptions, and mind maps. Since ThinkFlow processes data locally on your device, you are responsible for backing up your local data.

When you use AI mind map generation, transcription text is temporarily transmitted to our servers for processing. You grant us a limited license to process this data solely for the purpose of generating mind maps. We do not retain this data after processing.

5. Subscription and Payments

ThinkFlow offers subscription plans (Plus/Pro) with different usage limits and features. Subscriptions are processed through Apple's in-app purchase system.

Subscription terms: - Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period - You can manage and cancel subscriptions in your device's Settings > Apple ID > Subscriptions - No refunds for partial subscription periods unless required by applicable law

Free tier limitations: - Limited number of mind map generations per month - Basic Whisper model only - Standard export options

6. Acceptable Use

When using ThinkFlow, you agree not to: - Use the App for any illegal purpose - Process content that infringes intellectual property rights of others - Attempt to reverse engineer the App or its AI services - Interfere with or disrupt the App's operation - Attempt to gain unauthorized access to our systems - Use automated means to abuse the AI generation service - Circumvent subscription limits or usage restrictions

7. Intellectual Property

All intellectual property rights in the App, including software, design, trademarks, and documentation, belong to AppForges. The Whisper model is used under the MIT License from OpenAI.

You retain ownership of your videos, transcriptions, and generated mind maps. We claim no ownership over your content.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Specific disclaimers: - Speech recognition accuracy depends on audio quality, language, and selected model. We do not guarantee perfect transcription. - AI-generated mind maps may contain inaccuracies. Users should review and verify generated content. - Local processing performance depends on your device's hardware capabilities.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPFORGES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

We are not responsible for: - Loss of local data due to device failure or user error - Inaccuracies in speech recognition or AI-generated content - Service interruptions beyond our reasonable control

Our total liability shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time.

Upon termination: - Your local data (videos, transcriptions, mind maps) remains on your device - Your access to AI mind map generation and cloud features will cease - Active subscriptions should be cancelled through Apple to avoid further charges

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China. Any disputes arising from these Terms or your use of the App shall first be resolved through friendly negotiation. If negotiation fails, disputes shall be submitted to a court of competent jurisdiction.
